This Privacy Policy forms part of our User Agreement and describes how Fanz® LLC ("Fanz®," "we," "us," or "our") collects, uses, shares, and safeguards your personal information when you access or use the Fanz® platform. We value transparency, and this summary highlights the key points:

Information We Collect: We gather information you provide directly (such as account details, content you post, and payment data), information collected automatically (device data, usage patterns, cookies), and information obtained from third parties (social media platforms, analytics services, and sports data providers like ESPN).

How We Use It: We use your information to operate the Platform, personalize your experience, process payments via Stripe, deliver communications, display relevant advertising, ensure platform security, comply with legal obligations, and power AI-driven features such as Coach AI.

How We Share It: We may share your information with other users (per your privacy settings), service providers (including Stripe, Supabase, and Groq), business partners, and when legally required. We do not sell your personal information.

Your Rights: You may access, update, or delete your information; opt out of marketing communications; manage cookies; request data portability; and withdraw consent at any time. Residents of California and the European Economic Area have additional rights under the CCPA and GDPR respectively.

Data Security: We employ encryption, secure authentication protocols, regular security audits, and Row Level Security (RLS) at the database layer. No system is completely immune to risk, but we take commercially reasonable measures to protect your data.

Children's Privacy: Fanz® is not directed at children under 13 years of age. We comply with COPPA and will promptly delete any information collected from a child under 13 if we become aware of it. Users between 13 and 18 should use the Platform under parental supervision.

Policy Updates: We may revise this Privacy Policy periodically. Material changes will be communicated through the Platform, and your continued use following such changes constitutes acceptance.

Fanz® LLC ("Fanz®," "we," "us," or "our") operates the Fanz® platform, a sports-focused social media and engagement platform available through our website and mobile applications (collectively, the "Platform"). This Privacy Policy explains the types of information we collect from you, how that information is used and shared, and the steps we take to protect it.

By accessing or using the Platform, you acknowledge that you have read and understood this Privacy Policy and agree to the collection, use, and disclosure of your information as described herein. If you do not agree with any part of this Privacy Policy, you should discontinue use of the Platform immediately. This Privacy Policy should be read in conjunction with our Terms of Service.

1Information We Collect

1.1 Personal Information You Provide

When you register for an account or interact with the Platform, you may provide us with the following categories of personal information:

  • Account Information: Your chosen username, email address, password, profile picture, biography, and date of birth, which are necessary for creating and maintaining your account.
  • Profile Details: Optional information such as your sports preferences, favorite teams, geographic location, and any other biographical details you elect to include in your public or private profile.
  • User-Generated Content: Posts, comments, direct messages, photographs, videos, predictions, polls, and any other content you create, upload, or share through the Platform.
  • Payment Information: When you make purchases on the Platform (including subscriptions, tips, merchandise, or digital collectibles), billing and payment details are collected and processed by our third-party payment processor, Stripe. We do not store your complete credit card number or financial account credentials on our servers.
  • Communications: Information you provide when you contact our customer support team, respond to surveys, participate in promotions, or otherwise communicate with us through any channel.

1.2 Automatically Collected Information

When you access or use the Platform, we automatically collect certain technical and usage data, including:

  • Device Information: Your IP address, browser type and version, operating system, unique device identifiers, mobile carrier information, and hardware model.
  • Usage Data: Pages viewed, features used, time spent on the Platform, navigation paths, click patterns, search queries, and other behavioral data that helps us understand how you interact with the Platform.
  • Location Data: Approximate geographic location derived from your IP address. If you grant explicit permission, we may collect more precise location information from your device.
  • Cookies and Similar Technologies: We deploy cookies, web beacons, pixel tags, and comparable tracking technologies to collect data about your browsing activity, remember your preferences, and deliver a more personalized experience. You can manage your cookie preferences through your browser settings or our cookie management interface.

1.3 Information from Third Parties

We may receive information about you from external sources, including:

  • Social Media Platforms: If you choose to link your Fanz® account to a third-party social media service (such as Facebook, X/Twitter, or Instagram), we may receive your name, email address, profile picture, and other publicly available profile information from that service.
  • Analytics and Advertising Partners: We receive aggregated and de-identified data from analytics providers, advertising networks, and marketing partners that helps us measure Platform performance and improve our services.
  • Sports Data Providers: We obtain real-time scores, standings, player statistics, schedules, and other sports-related data from ESPN and other licensed data providers to power features within the Platform.

2How We Use Your Information

We process the information we collect for the following purposes:

  • Platform Functionality: To create and manage your account, authenticate your identity, deliver content, enable social features, and ensure the Platform operates as intended.
  • Personalization: To tailor the content, teams, users, and features displayed to you based on your stated preferences, past activity, and engagement patterns.
  • Communication: To send you transactional notifications (such as account confirmations and purchase receipts), as well as promotional messages, newsletters, and Platform updates. You may opt out of promotional communications at any time.
  • Payment Processing: To facilitate transactions including subscriptions, creator tips, merchandise purchases, and digital collectible acquisitions through our integration with Stripe.
  • Analytics and Platform Improvement: To analyze usage trends, monitor Platform performance, diagnose technical issues, and develop new features and services.
  • Advertising: To deliver interest-based advertisements that are relevant to your activity and preferences. You may have the ability to adjust your advertising preferences in your account settings.
  • Security and Fraud Prevention: To detect, investigate, and prevent unauthorized access, security incidents, fraudulent transactions, spam, and violations of our Terms of Service.
  • Legal Compliance: To fulfill our legal and regulatory obligations, respond to lawful requests from public authorities, and protect our rights and the rights of third parties.
  • AI-Powered Features: To provide AI-driven tools and experiences, including Coach AI, AI Scout, AI Analyst, and AI Hypeman personalities, which deliver personalized sports insights, strategic commentary, and interactive engagement. These features may process your activity data, preferences, and content to generate tailored responses.

3How We Share Your Information

We may disclose your information under the following circumstances. We do not sell your personal information to third parties.

3.1 With Other Users

Certain information you provide -- including your profile details, posts, comments, predictions, and other user-generated content -- may be visible to other Platform users in accordance with your privacy settings. Public profiles and public content are accessible to all users and may be indexed by search engines. You can manage the visibility of your information through your account privacy settings.

3.2 With Service Providers

We engage trusted third-party vendors who perform functions on our behalf. These service providers are contractually obligated to use your data solely for the purposes we specify and in compliance with this Privacy Policy. Our key service providers include:

  • Stripe for secure payment processing and transaction management
  • Supabase for cloud database hosting and backend infrastructure
  • Analytics providers (such as Google Analytics and PostHog) for Platform usage analysis
  • AI service providers (such as Groq and OpenAI) to power our AI-driven features and capabilities
  • Email and communication service providers for delivering notifications and marketing messages
  • Customer support platforms for managing help center inquiries and support tickets

3.3 With Business Partners

We may share aggregated or de-identified data with advertising partners, sponsors, and other business collaborators for the purpose of delivering relevant promotions, measuring campaign effectiveness, and developing joint offerings. 3.5 Business Transfers

In the event that Fanz® undergoes a merger, acquisition, reorganization, asset sale, bankruptcy proceeding, or similar corporate transaction, your personal information may be transferred to the acquiring entity or successor as part of that transaction. We will provide notice of any such transfer and any changes to applicable privacy practices before your personal information becomes subject to a materially different privacy policy.

4Data Retention

We retain your personal information for as long as reasonably necessary to fulfill the purposes for which it was collected, provide the Platform and its services, comply with our legal and regulatory obligations, resolve disputes, and enforce our agreements.

When you request deletion of your account, we will delete or anonymize your personal information within a commercially reasonable timeframe, except where retention is required or permitted by applicable law (for example, to maintain financial transaction records, comply with tax obligations, or support fraud prevention efforts). Certain aggregated or de-identified data that can no longer be associated with you may be retained indefinitely for analytical purposes.

5Your Rights and Choices

Depending on your jurisdiction, you may exercise the following rights with respect to your personal information:

5.1 Access and Update

You may access and modify your account information, profile details, and privacy settings at any time through your account dashboard. If you require assistance, you may contact us at support@fanz.us.

5.2 Delete Your Account

You may request the deletion of your account and associated personal data by navigating to your account settings or by contacting us at support@fanz.us. Please note that certain data may be retained as described in Section 4 (Data Retention) above.

5.3 Opt-Out of Communications

You can opt out of promotional emails at any time by clicking the "unsubscribe" link included in each promotional message or by updating your notification preferences in your account settings. Please note that even after opting out, you will continue to receive transactional communications related to your account and purchases.

5.4 Manage Cookies

You can control and manage cookies through your browser settings or our cookie consent interface. Most browsers allow you to block or delete cookies. Please be aware that disabling certain cookies may impair your ability to use some features of the Platform. For more details, see our Cookie Policy.

5.5 Data Portability

You may request a copy of your personal information in a structured, commonly used, and machine-readable format by contacting us at privacy@fanz.us. We will fulfill such requests within the timeframe required by applicable law.

5.6 Withdraw Consent

Where we rely on your consent as the legal basis for processing your personal information, you have the right to withdraw that consent at any time. Withdrawal of consent does not affect the lawfulness of any processing carried out before the withdrawal, nor does it affect processing conducted on other lawful grounds.

6Children's Privacy (COPPA Compliance)

The Platform is not intended for, and we do not knowingly collect personal information from, children under the age of 13. In compliance with the Children's Online Privacy Protection Act (COPPA), if we discover that a child under 13 has provided us with personal information without verified parental consent, we will take immediate steps to delete that information from our systems.

For users between 13 and 18 years of age, we strongly recommend that a parent or legal guardian supervise their use of the Platform and review this Privacy Policy together. Parents and guardians who believe their child may have provided personal information to Fanz® without appropriate consent should contact us immediately at privacy@fanz.us.

7International Data Transfers

Fanz® is headquartered in the United States. Your personal information may be transferred to, stored in, and processed in the United States or other jurisdictions in which our service providers maintain facilities. These jurisdictions may have data protection laws that differ from those in your country of residence.

By using the Platform, you consent to the transfer of your information to the United States and other applicable jurisdictions. For users located in the European Economic Area (EEA), United Kingdom (UK), or Switzerland, we implement appropriate safeguards -- including Standard Contractual Clauses and other transfer mechanisms approved by applicable data protection authorities -- to ensure that your personal data receives an adequate level of protection in compliance with the General Data Protection Regulation (GDPR) and related legislation.

8Data Security

We take the security of your personal information seriously and employ a combination of administrative, technical, and organizational measures designed to protect your data against unauthorized access, alteration, disclosure, or destruction. These measures include:

  • Encryption: Data is encrypted both in transit (using TLS/SSL) and at rest to safeguard against interception and unauthorized access.
  • Secure Authentication: We use industry-standard authentication protocols, including secure password hashing and support for multi-factor authentication where available.

9Third-Party Links and Services

The Platform may contain links to, or integrations with, third-party websites, applications, and services that are not owned or controlled by Fanz®. We are not responsible for the privacy practices, content, or security of these third-party services. We encourage you to review the privacy policies of any third-party service before providing personal information to them.

Our Platform currently integrates with the following third-party services, among others:

  • ESPN API: For real-time sports data including scores, statistics, schedules, and news.
  • Stripe: For secure payment processing, subscription management, and financial transaction handling.
  • YouTube and Twitch: For embedded video content, livestreaming integration, and multimedia experiences.
  • Groq and OpenAI: For powering our AI-driven features including Coach AI, AI Scout, AI Analyst, and other intelligent sports tools.
  • Blockchain Networks: For digital collectible (NFT) functionality, including minting, ownership verification, and marketplace features.

Each of these providers operates under its own privacy policy and terms of service, which govern their collection and use of your data independently of this Privacy Policy.

10California Privacy Rights (CCPA)

If you are a resident of the State of California, the California Consumer Privacy Act (CCPA), as amended by the California Privacy Rights Act (CPRA), grants you the following additional rights regarding your personal information:

  • Right to Know: You have the right to request that we disclose the categories and specific pieces of personal information we have collected about you over the preceding 12 months, the categories of sources from which it was collected, the business or commercial purpose for the collection, and the categories of third parties with whom it was shared.
  • Right to Delete: You have the right to request that we delete your personal information, subject to certain exceptions permitted under the CCPA (such as data necessary to complete a transaction, detect security incidents, or comply with legal obligations).
  • Right to Opt-Out of Sale or Sharing: You have the right to direct us not to sell or share your personal information. Fanz® does not sell personal information to third parties as "sale" is defined under the CCPA. If this practice changes, we will provide you with a clear opt-out mechanism.
  • Right to Non-Discrimination: We will not deny you goods or services, charge different prices, provide a different quality of service, or otherwise discriminate against you for exercising any of your CCPA rights.

To exercise any of these rights, please visit our Do Not Sell My Personal Information page, submit a verifiable consumer request to us at privacy@fanz.us or by contacting us using the information provided in Section 13. We will respond to your request within 45 days, as required by law.

11European Privacy Rights (GDPR)

If you are located in the European Economic Area (EEA), the United Kingdom (UK), or Switzerland, the General Data Protection Regulation (GDPR) and applicable local implementations afford you the following rights:

  • Right of Access: You may request confirmation of whether we process your personal data, along with a copy of the data and information about the purposes and legal bases of our processing.
  • Right to Rectification: You may request that we correct inaccurate or incomplete personal data without undue delay.
  • Right to Erasure: You may request deletion of your personal data where it is no longer necessary for the purpose for which it was collected, where you withdraw consent, or where processing is otherwise unlawful (the "right to be forgotten").
  • Right to Restrict Processing: You may request that we temporarily limit the processing of your personal data in certain circumstances, such as when you contest its accuracy or object to our processing.
  • Right to Data Portability: You may request a copy of your personal data in a structured, commonly used, machine-readable format, and you may request that we transmit that data directly to another controller where technically feasible.
  • Right to Object: You may object to the processing of your personal data for direct marketing purposes or where processing is based on our legitimate interests, unless we demonstrate compelling legitimate grounds for continued processing.
  • Right to Withdraw Consent: Where processing is based on your consent, you may withdraw that consent at any time. Such withdrawal does not affect the lawfulness of processing carried out prior to the withdrawal.
  • Right to Lodge a Complaint: You have the right to file a complaint with your local data protection supervisory authority if you believe that our processing of your personal data violates the GDPR.

12Changes to This Privacy Policy

We reserve the right to modify this Privacy Policy at any time to reflect changes in our data practices, applicable laws, or business operations. When we make material changes, we will update the "Effective Date" at the top of this page and provide reasonable notice through the Platform (such as a banner notification, email, or in-app alert) prior to the changes taking effect.

Your continued use of the Platform following the effective date of any revised Privacy Policy constitutes your acceptance of the updated terms. We encourage you to periodically review this page to stay informed of how we collect, use, and protect your information.

Addendum: COPPA Compliance for Minor Users

This addendum supplements the Privacy Policy above and provides additional detail regarding how Fanz® addresses the privacy and safety of users under 18 years of age, in accordance with the Children's Online Privacy Protection Act (COPPA) and related child safety best practices.

A. Age Verification

During account registration, all users are required to provide their date of birth. We use this information to determine whether a user meets the minimum age requirement for Platform access. Users who indicate they are under 13 years of age are prohibited from creating an account. If we later determine that a user misrepresented their age and is in fact under 13, we will suspend the account and delete the associated personal information as promptly as practicable.

B. Parental Consent

For users between 13 and 18 years of age, we strongly encourage parental or guardian involvement in the registration process and ongoing use of the Platform. In jurisdictions where verifiable parental consent is required before collecting personal information from minors, we will implement appropriate consent mechanisms. Parents or guardians may contact us at privacy@fanz.us to review, modify, or request deletion of their child's personal information.

C. Data Collection Limitations for Minors

We limit the personal information collected from users identified as minors (ages 13 through 17) to the minimum necessary for Platform functionality. We do not serve behaviorally targeted advertising to users under 18 and restrict the sharing of minor user data with third-party advertising partners. Any AI-powered features used by minor accounts are configured to process only the data essential for delivering the requested functionality.

D. Parental Rights and Controls

Parents and legal guardians of minor users have the right to:

  • Review the personal information collected from their child
  • Request correction of inaccurate information
  • Request deletion of their child's account and associated personal data
  • Refuse to permit further collection or use of their child's information
  • Manage privacy settings and content visibility on their child's behalf

E. Safety Protections for Minor Accounts

Accounts identified as belonging to users under 18 are subject to enhanced safety protections, which may include:

  • Default privacy settings that restrict profile visibility to approved connections
  • Restrictions on direct messaging from users who are not mutual connections
  • Enhanced content moderation filters applied to the minor's feed and interactions
  • Limitations on the ability to share precise location information
  • Restrictions on participation in features that involve real-money transactions without parental authorization

F. Minor Monetization Controls

Users under 18 are subject to additional controls regarding monetary features on the Platform. Minor users may not access certain monetization features (such as receiving tips, selling merchandise, or listing digital collectibles) without verified parental or guardian consent. Any earnings or monetary transactions associated with a minor account may require parental oversight and approval before funds can be withdrawn or transferred.

G. Educational and NIL Context

Fanz® recognizes that many minor users may be student athletes exploring Name, Image, and Likeness (NIL) opportunities. We are committed to providing a safe environment for young athletes to build their personal brand while maintaining appropriate privacy safeguards. Any NIL-related features available to minor users are designed with additional protections, including restrictions on the types of personal information that may be made publicly available, mandatory parental consent for NIL-related agreements facilitated through the Platform, and compliance with applicable state NIL laws governing minor athletes. By using the Fanz® platform, you acknowledge that you have read, understood, and agree to be bound by this Privacy Policy and the COPPA Compliance Addendum set forth above.
