Third-Party Sports IP Licensing on Fanz®

Effective Date: February 10, 2026

This Fan License Framework ("Framework") establishes the rules and licensing tiers governing the use of third-party sports intellectual property ("Sports IP") on the Fanz® platform. Sports IP includes team names, league trademarks, athlete likenesses, official logos, broadcast content, and any other materials owned or controlled by sports organizations, leagues, teams, or athletes. This Framework is part of the Fanz® User Agreement and applies to all users of the Platform.

This Framework is provided by Fanz® LLC, Colorado 80550, USA.

1Framework Overview

Fanz® operates a three-tier licensing system designed to balance fan expression, creator freedom, and the rights of sports IP owners. This system ensures that fans can engage passionately with their favorite teams and athletes while respecting the intellectual property rights of leagues, teams, broadcasters, and individual athletes.

The three tiers are structured to accommodate the full spectrum of fan and creator activity on the Platform:

Tier 1: Fan Expression

Free and automatic for all users. Covers non-commercial fan activity.

Tier 2: Creator License

For monetized content creators in the Creator Program.

Tier 3: Commercial License

For merchandise, NFTs, branded experiences, and collaborations.

Each tier builds upon the previous one. Users operating at higher tiers retain all privileges of lower tiers. Fanz® reserves the right to reclassify user activity between tiers at its sole discretion if the nature of a user's content or commercial activity changes.

2Tier 1: Fan Expression License

Automatic · Free · All Users

The Fan Expression License is automatically granted to every registered Fanz® user at no cost. This license covers everyday fan activity and is designed to protect the rights of fans to discuss, celebrate, and engage with the sports they love.

Permitted Activities

  • Discussion and Commentary: Posting opinions, analysis, game recaps, and discussions about teams, players, games, and leagues.
  • Fan Art: Creating and sharing original artwork, graphics, memes, and other creative expressions inspired by sports teams and athletes, provided such works are clearly fan-made and non-commercial.
  • Predictions and Analysis: Making game predictions, sharing statistical analysis, participating in prediction markets, and engaging in fantasy sports discussions.
  • Team Affiliations: Displaying team preferences in profiles, using team-related hashtags, joining team-specific groups, and expressing fandom through profile customization.
  • Commentary on News: Sharing reactions to and commentary on publicly available sports news, press conferences, and official announcements.

Restrictions

  • No Endorsement Implication: Users may not create content that implies or suggests endorsement, sponsorship, or affiliation with any sports organization, team, league, or athlete unless such a relationship actually exists.
  • No Official Logos in User Content: Users may not incorporate official team logos, league marks, or other registered trademarks into their original user-generated content (e.g., overlaying an official logo onto a custom graphic). Platform-provided team badges and icons are excluded from this restriction.
  • No Commercial Use: Fan Expression License holders may not monetize content that incorporates Sports IP. Any monetization of sports-related content requires a Tier 2 or Tier 3 license.

3Tier 2: Creator License

Creator Program · Monetized Content

The Creator License is available to users who participate in the Fanz® Creator Program and wish to create monetized content that references or incorporates Sports IP.

Eligibility

To qualify for a Tier 2 Creator License, users must:

  • Be enrolled in the Fanz® Creator Program at Silver tier or above
  • Maintain good standing with no active content policy violations
  • Complete the Creator License acknowledgment during Creator Program onboarding
  • Comply with all applicable FTC disclosure requirements

Permitted Activities

  • Monetized Commentary: Creating revenue-generating posts, videos, podcasts, and other content that includes commentary on sports teams, players, and games. This includes content eligible for Fanz® tipping, subscriptions, and ad revenue sharing.
  • Sponsored Content with FTC Disclosure: Publishing sponsored content that references Sports IP, provided all sponsorship relationships are clearly disclosed in accordance with FTC guidelines and Fanz® disclosure requirements.
  • Revenue-Generating Analysis: Producing paid sports analysis, premium predictions, statistical breakdowns, and other analytical content behind paywalls or through other monetization mechanisms.

Restrictions

  • No Official Logos in Monetized Content: Creators may not use official team logos, league trademarks, or registered marks in content that generates revenue. Descriptive text references (e.g., team names in written commentary) are permitted.
  • Attribution Required: All monetized content referencing Sports IP must include appropriate attribution identifying the relevant rights holders (e.g., "All team names and trademarks are the property of their respective owners").

Compliance Monitoring

Fanz® actively monitors Creator License compliance through automated content scanning and periodic manual review. Creators found in violation of Tier 2 restrictions will receive a notice and may be subject to demonetization, license downgrade, or account suspension as described in Section 6.

4Tier 3: Commercial License

Commercial Use · Negotiated Terms

The Commercial License is required for any use of Sports IP on the Fanz® platform that involves merchandise, NFTs, branded experiences, or official collaborations with sports organizations, teams, leagues, or athletes.

Covered Activities

  • Merchandise: Selling physical or digital merchandise that incorporates Sports IP, including apparel, accessories, collectibles, and other goods.
  • NFTs and Digital Collectibles: Minting, listing, or selling NFTs or digital collectibles that incorporate Sports IP, athlete likenesses, or sports-related imagery.
  • Branded Experiences: Creating sponsored events, virtual experiences, interactive campaigns, or other branded activations that use Sports IP.
  • Official Collaborations: Partnering with teams, leagues, athletes, or sports organizations for co-branded content, campaigns, or products distributed through the Fanz® platform.

Application Process

Commercial License applications are submitted through the Fanz® Partner Portal or by contacting partnerships@fanz.us. Each application is reviewed individually. Applicants must provide:

  • A detailed description of the proposed commercial activity
  • Identification of all Sports IP to be used
  • Evidence of any existing licensing agreements with IP owners
  • Business registration documentation
  • Proposed timeline and scope of use

Terms

Commercial License terms are individually negotiated based on the scope and nature of the proposed activity. All Commercial Licenses are issued for an initial period of twelve (12) months and are subject to renewal. Specific terms, including revenue-sharing arrangements, usage limitations, approval workflows, and reporting requirements, are defined in the individual Commercial License agreement.

5Escalation Path

The Fan License Framework is designed to provide a clear escalation path from free fan expression to licensed commercial use. As users grow their presence and commercial activity on the Platform, they can progress through the tiers:

Tier 1 to Tier 2

Enroll in the Fanz® Creator Program and achieve Silver tier status. Complete the Creator License acknowledgment. Begin monetizing sports-related content within the Tier 2 permitted activities.

Tier 2 to Tier 3

Submit a Commercial License application through the Partner Portal or via partnerships@fanz.us. Provide required documentation and proposed use case. Negotiate and execute a Commercial License agreement with Fanz®.

Users who engage in activity that exceeds their current tier's permissions without obtaining the appropriate license will be notified and given a reasonable period to either cease the activity or apply for an upgraded license. Continued violations will be handled under the Revocation and Enforcement provisions in Section 6.

6Revocation and Enforcement

Fanz® reserves the right to revoke, suspend, or downgrade any license tier at any time if a user violates the terms of this Framework, the Fanz® User Agreement, or applicable law. Enforcement actions may include:

  • Content Removal: Removal of specific content that violates the applicable license tier restrictions.
  • License Downgrade: Reduction from Tier 2 or Tier 3 to a lower tier, with loss of associated privileges.
  • Demonetization: Suspension or termination of monetization privileges for Creator License holders.
  • Account Suspension: Temporary suspension of platform access for repeat or serious violations.
  • Account Termination: Permanent removal from the platform for egregious or willful violations.
  • Legal Action: Fanz® reserves the right to pursue legal remedies, including but not limited to injunctive relief and damages, for violations that cause harm to Fanz®, its users, or third-party IP holders.

Fanz® will make reasonable efforts to notify users of enforcement actions and provide an opportunity to appeal, except in cases where immediate action is necessary to protect the rights of IP holders or the integrity of the platform. Appeals may be submitted to legal@fanz.us within fourteen (14) days of receiving an enforcement notice.
