DMCA Copyright Policy

Digital Millennium Copyright Act Notice and Takedown Procedures

Effective Date: February 10, 2026

Fanz® LLC ("Fanz®," "we," "us," or "our") respects the intellectual property rights of others and expects our users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 ("DMCA"), 17 U.S.C. § 512, we have established the following procedures for responding to claims of copyright infringement on our platform.

1Designated Copyright Agent

Fanz® LLC has designated a Copyright Agent to receive notifications of claimed copyright infringement in accordance with 17 U.S.C. § 512(c)(2). All DMCA takedown notices should be directed to our designated agent using the contact information below.

2Filing a DMCA Takedown Notice

If you believe that content hosted on the Fanz® platform infringes your copyright, you may submit a written takedown notice to our Designated Copyright Agent. Under 17 U.S.C. § 512(c)(3), your notice must include all of the following elements to be effective:

  • i.

    Physical or Electronic Signature — A physical or electronic signature of the copyright owner or a person authorized to act on behalf of the copyright owner.

  • ii.

    Identification of Copyrighted Work — Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works are covered by a single notification, a representative list of such works.

  • iii.

    Identification of Infringing Material — Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit us to locate the material (e.g., direct URL links).

  • iv.

    Contact Information — Your name, mailing address, telephone number, and email address so that we may contact you regarding the complaint.

  • v.

    Good Faith Statement — A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.

  • vi.

    Statement Under Penalty of Perjury — A statement, made under penalty of perjury, that the information in the notification is accurate and that you are the copyright owner or are authorized to act on behalf of the copyright owner.

Important: Incomplete notices may not receive a response. We may request additional information before processing a takedown notice that does not substantially comply with the statutory requirements.

3Platform Response

Upon receiving a valid DMCA takedown notice that complies with all statutory requirements, Fanz® will take the following actions:

  • Remove or Disable Access — Promptly remove or disable access to the allegedly infringing material.

  • Notify the User — Notify the user who posted the content that material has been removed or disabled due to a copyright infringement claim.

  • Provide Counter-Notification Information — Inform the affected user of their right to file a counter-notification if they believe the removal was made in error.

  • Maintain Records — Maintain records of all takedown notices and counter-notifications received for compliance and enforcement purposes.

Response Target: Fanz® aims to process and respond to valid DMCA takedown notices within 2 business days of receipt.

4Counter-Notification Process

If you believe that material you posted was removed or disabled as a result of mistake or misidentification, you may file a counter-notification with our Designated Copyright Agent. Under 17 U.S.C. § 512(g)(3), a valid counter-notification must include:

  • i.

    Physical or Electronic Signature — Your physical or electronic signature.

  • ii.

    Identification of Removed Material — Identification of the material that has been removed or to which access has been disabled, and the location at which the material appeared before it was removed or disabled.

  • iii.

    Statement Under Penalty of Perjury — A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.

  • iv.

    Consent to Jurisdiction — Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or the District of Colorado if your address is outside of the United States), and that you will accept service of process from the person who provided the original takedown notification or an agent of such person.

Restoration Timeline

Upon receipt of a valid counter-notification, Fanz® will forward a copy to the original complaining party. If the original complaining party does not file a court action seeking to restrain the user from engaging in the allegedly infringing activity within 10 to 14 business days of receiving the counter-notification, Fanz® will restore access to the removed material.

5Repeat Infringer Policy

In accordance with the DMCA and other applicable law, Fanz® has adopted a policy of terminating the accounts of users who are deemed to be repeat infringers in appropriate circumstances.

Strike System — Each valid DMCA takedown notice received against a user's content constitutes one strike. Strikes expire after 12 months from the date they are issued.

Three Strikes — A user who accumulates 3 strikes within a 12-month period will be subject to permanent termination of their account and access to the Fanz® platform.

Discretionary Actions — Fanz® reserves the right to terminate any account at any time if the user's conduct warrants such action, even with fewer than three strikes.

6Good Faith and Misrepresentation

The DMCA provides that any person who knowingly materially misrepresents that material or activity is infringing, or that material or activity was removed or disabled by mistake or misidentification, may be subject to liability under 17 U.S.C. § 512(f).

Warning

Filing a fraudulent or bad-faith DMCA notice or counter-notification may result in liability for damages, including costs and attorneys' fees incurred by the alleged infringer, the copyright owner, or the service provider. Before submitting a DMCA notice or counter-notification, you should consider consulting with an attorney to understand your rights and obligations under the DMCA.

Fanz® reserves the right to seek damages from any party that submits a DMCA notification or counter-notification in bad faith.

7DMCA Safe Harbor

Fanz® operates as an online service provider within the meaning of 17 U.S.C. § 512. As a user-generated content platform, Fanz® does not monitor, screen, or editorially control all content uploaded by users prior to its appearance on the platform.

Fanz® qualifies for the safe harbor protections provided under Section 512(c) of the DMCA for content stored at the direction of users. In compliance with these provisions, Fanz®:

  • Has designated an agent with the U.S. Copyright Office to receive notifications of claimed infringement.

  • Expeditiously removes or disables access to material upon receiving valid takedown notices.

  • Has implemented and reasonably enforces a repeat infringer policy.

  • Does not interfere with standard technical measures used by copyright owners to identify or protect copyrighted works.

8Sports Content and Broadcast Rights

Given the nature of the Fanz® platform as a sports-focused social media service, users should be aware of the following considerations regarding sports content and broadcast rights:

Broadcast Content — Live sports broadcasts, recorded game footage, and related broadcast content are typically protected by copyright. Unauthorized reproduction, redistribution, or retransmission of such content on the Fanz® platform may constitute copyright infringement.

Fair Use for Commentary — Users may have fair use defenses when using limited portions of copyrighted sports content for purposes of commentary, criticism, news reporting, or education. However, fair use is a fact-specific legal determination that depends on the particular circumstances of each case, including the amount of material used, the purpose of the use, and the effect on the market for the original work.

Rights Holder Enforcement — Professional sports leagues, broadcasters, and other rights holders actively monitor and enforce their intellectual property rights. Users who upload infringing content may receive DMCA takedown notices and be subject to our repeat infringer policy.
